1. Agreement to these Terms

1.1 Entry into the Competition is deemed acceptance of these Terms and Conditions (“Terms”). Information on how to enter and the Prize forms part of these Terms.

1.2 Where there is any inconsistency between these Terms and any other material published about the Competition, these Terms prevail.

1.3 These Terms do not exclude, restrict or modify any right or remedy an entrant has under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified by agreement.

2. Promoter

2.1 The Promoter is Hot Spring Spa Australasia Pty Ltd (ACN 056 538 820, ABN 52 056 538 820) of Unit 3B, 6–8 Hudson Avenue, Castle Hill NSW 2154.

2.2 Questions and complaints about the Competition may be directed to [email protected] or 1800 148 688. The Promoter will acknowledge a complaint within two business days and respond within ten business days.

2.3 The Event Organiser, the Event’s naming rights partner, Meta Platforms, Inc. and TikTok are not promoters of the Competition and have no responsibility for it.

3. Competition Period

3.1 The Competition opens at 9.00am AEST on Saturday 24 October 2026 and closes at 11.59pm AEST on Thursday 5 November 2026. Entries received after the Closing Time are invalid.

3.2 The time of receipt of an entry is the time it is recorded by the Promoter’s entry system, which is conclusive.

4. Eligibility

4.1 Entry is open to individuals who, at the time of entry, are 18 years of age or over and reside in Australia (“Entrant”). A Guest does not enter the Competition; the requirements for a Guest are in clause 8.

4.2 The Promoter may require an Entrant, the Winner or a Guest to provide proof of age, identity and residential address (for example a current Australian driver licence, passport or proof of age card together with evidence of address) before any Prize is awarded. For a Child Guest, the Promoter may require evidence of the child’s age and of the Winner’s relationship to the child (for example a birth certificate, a Medicare card listing both the Winner and the child, or a court order appointing the Winner as the child’s guardian). A person who cannot provide satisfactory proof may be disqualified or, in the case of a Guest, refused.

5. Excluded persons

5.1 The following persons are not eligible to enter or to be a Guest (including a Child Guest):

  • directors, officers, employees and contractors of the Promoter and of its related bodies corporate (including Hot Spring Spas New Zealand Limited);
  • owners, directors and employees of authorised Hot Spring dealers in Australia;
  • directors, employees and contractors of the Event Organiser, of So What Social, of Vyne and of any other agency or supplier directly engaged in the Competition; and
  • the spouse, de facto partner, parent, child, sibling or household member of any person in paragraphs (a) to (c).

6. How to enter

6.1 To enter, an Entrant must, during the Competition Period, visit the Website and submit the entry form with the Entrant’s first name, last name, email address, Australian mobile number, residential state or territory and postcode, confirm that the Entrant is 18 years or over and an Australian resident, and accept these Terms.

6.2 Entry is free. No purchase is necessary. Entrants bear only their own cost of accessing the internet.

6.3 Entrants are not required to follow, like, share, comment on or tag any person in any social media post to enter. Doing so has no effect on an Entrant’s chance of winning.

6.4 Each individual may enter once. The Promoter will identify duplicate entries by considering together the full name, email address and mobile number provided with each entry, and may investigate where the information indicates that the same individual has entered more than once using different details. A match on name alone will not of itself invalidate an entry. Where the Promoter is satisfied that the same individual has entered more than once, only that individual’s first valid entry is accepted and the others are invalid.

6.5 Entries that are incomplete, illegible, generated by script, macro, bot or other automated means, or submitted other than through the Website are invalid.

6.6 Every valid entry has an equal chance of being drawn.

6.7 The Promoter is not responsible for entries that are lost, delayed or not received due to a technical failure or any cause outside the Promoter’s reasonable control. If the Website is unavailable for a material period during the Competition Period, the Promoter may extend the Closing Time by publishing a notice on the Website and, where required, obtaining the approval of a regulator (see clause 24).

7. Personal information collected at entry

7.1 The information collected at entry is used to administer the Competition, validate entries, contact the Winner and Reserve Entrants, fulfil the Prize and meet the Promoter’s legal obligations. See clause 22 (Privacy).

7.2 Entrants may separately choose to receive marketing communications from the Promoter. That choice is optional, is not a condition of entry and does not affect an Entrant’s chance of winning. See clause 23.

8. Guest

8.1 The Winner may bring one guest (“Guest”). The Guest must be either:

  • a person aged 18 years or over who is not an excluded person under clause 5 (“Adult Guest”); or
  • a child aged 6 to 17 years who is the Winner’s own child, or a child for whom the Winner is the legal guardian (“Child Guest”).

The Winner must nominate the Guest by the Acceptance Deadline and return the Guest Acceptance Form, signed by the Guest or, for a Child Guest, by the Winner as the child’s parent or legal guardian. By signing, the Guest (or the Winner on behalf of a Child Guest) agrees to these Terms, including clauses 9, 17, 18, 19 and 20.

8.2 The Winner may substitute the Guest once, by written request to the Promoter, up to 5.00pm AEST on Tuesday 17 November 2026, provided the substitute Guest meets clause 8.1 and the airline permits the change. Any airline change fee resulting from a substitution requested by the Winner is payable by the Winner.

8.3 The Winner and the Guest must travel together on the same flights and share the one hotel room.

8.4 If the Guest withdraws or is unable to travel and no substitute is nominated in time, the Winner may still take the Prize alone. No cash or other alternative is given for the Guest’s share.

8.5 Where the Guest is a Child Guest:

  • the Winner is responsible for the Child Guest at all times during travel, at the hotel and at the Venue, and must not leave the Child Guest unattended;
  • the Winner must remain within arm’s reach of the Child Guest whenever the Child Guest is in or beside the spa, and must leave the spa whenever the Child Guest leaves it;
  • the Promoter’s staff, Event staff and Venue staff do not supervise the Child Guest;
  • no alcohol will be served to the Child Guest, and no alcohol will be served to the Winner while the Child Guest is in or beside the spa; and
  • the Winner must bring the Child Guest’s identification (such as a Medicare card, passport or birth certificate) for the airline, the hotel and Event staff.

9. The Prize

9.1 There is one Prize. The Prize consists of the following for the Winner and the Guest:

  • Flights: return economy class airfares for two people from the Winner’s Departure City (clause 11) to Cairns, including airline taxes and charges, carry-on baggage and one checked bag of up to 20 kg per person;
  • Accommodation: one night’s accommodation on Sunday 22 November 2026 at Pullman Cairns International, 17 Abbott Street, Cairns, in one room with twin or double bedding (as the Winner requests, subject to availability), including breakfast for two on Monday 23 November 2026 (clause 12);
  • Transfers: ground transfers in Cairns between the airport, the hotel and the Venue, arranged by the Promoter;
  • Tickets: two general admission tickets to the Event (an adult ticket for the Winner and an adult or child ticket for the Guest, as applicable);
  • Hospitality: access for the Winner and the Guest to the Hot Spring sideline hospitality area at the Venue (“Hospitality Area”) during the Event, with food and non-alcoholic beverages, and, for the Winner and an Adult Guest, alcoholic beverages subject to clause 18; and
  • Spa Experience: the opportunity for the Winner and the Guest to watch the first innings of the Event from a Hot Spring spa positioned on the sideline of the playing field, subject to clause 17 (“Spa Experience”).

9.2 Everything not expressly included in clause 9.1 is excluded, including meals and drinks outside the Hospitality Area, hotel incidentals (minibar, room service, parking, telephone, laundry), travel to and from the Departure City airport, travel insurance, seat selection, in-flight purchases, additional baggage, spending money and any other cost of a personal nature.

9.3 The Prize is not transferable, cannot be exchanged and cannot be redeemed for cash. The Winner cannot nominate another person to take the Prize in the Winner’s place.

9.4 The Prize must be taken on the dates stated in these Terms. It cannot be taken on other dates.

9.5 Attendance at the Event is subject to the Event Organiser’s terms and conditions of entry (published at goldclash.com.au) and the Venue’s conditions of entry. The Winner and the Guest must comply with them and with the reasonable directions of Event staff, Venue staff and the Promoter’s staff.

9.6 The Promoter does not control the Event. The line-up of players, the match format and the timing of the Event may change. The Promoter is not responsible for the conduct or content of the Event.

10. Prize value

10.1 The total maximum value of the Prize is up to AUD $2,970 (GST inclusive), calculated at retail value as at 20 October 2026 for the most expensive combination of Prize elements a Winner could receive (a Winner travelling from Darwin).

10.2 The actual value of the Prize depends on the Winner’s Departure City and the fares and rates available when bookings are made. An indicative breakdown is: airfares up to $2,040; accommodation and breakfast $370; transfers $100; tickets $158; hospitality and Spa Experience $300.

10.3 The Promoter accepts no responsibility for any variation in the value of the Prize.

11. Flights and Departure City

11.1 “Departure City” means the capital city airport of the state or territory in which the Winner resides: Sydney, Melbourne, Brisbane, Adelaide, Perth, Hobart, Darwin or Canberra. The Winner’s residential address will be verified under clause 4.2.

11.2 Winners who reside outside a capital city are responsible for their own travel to and from the Departure City airport, at their own cost.

11.3 Winners who reside within 200 km of Cairns do not receive flights or airport transfers and are responsible for their own travel to Cairns. All other elements of the Prize apply.

11.4 The Promoter will book flights that arrive in Cairns on Sunday 22 November 2026 in time for the Event. Where the Promoter determines, acting reasonably, that no suitable same-day flight is available from the Departure City, the Promoter may instead book a flight departing the Departure City on the evening of Saturday 21 November 2026 and arriving in Cairns on Sunday 22 November 2026. No accommodation is provided for the night of Saturday 21 November 2026. Return flights will depart Cairns on Monday 23 November 2026.

11.5 The Promoter selects the airline, routing (which may include one connection) and flight times, and books and pays for the flights. The Promoter will consult the Winner about the available options, will book promptly after the Winner and the Guest have accepted under clause 15, and will send the itinerary to the Winner by email.

11.6 The Winner and an Adult Guest must each hold valid photographic identification in the name used for the booking. The Winner must carry the identification for a Child Guest described in clause 8.5(e). All travellers must comply with the airline’s conditions of carriage. Any change to a booking requested by the Winner or the Guest after it is made is subject to airline availability and any fees are payable by the person requesting the change.

11.7 If a flight is delayed or cancelled by the airline, the Promoter will use reasonable endeavours to arrange alternative flights so that the Winner and the Guest can attend the Event. The Promoter is not responsible for airline delays or cancellations that are outside its reasonable control, but nothing in this clause limits the Winner’s rights against the airline or under the Australian Consumer Law.

11.8 If the Winner or the Guest misses a flight for a reason within their control, the Promoter is not obliged to provide replacement flights or any compensation.

11.9 Travel insurance is not included. The Winner and the Guest are responsible for arranging any insurance they require.

12. Accommodation

12.1 Accommodation is one room for two people at Pullman Cairns International for the night of Sunday 22 November 2026, with breakfast for two on the morning of Monday 23 November 2026.

12.2 The hotel may require a credit card or deposit from the Winner on check-in to cover incidental charges. All incidental charges are payable by the Winner.

12.3 If the Pullman Cairns International cannot accommodate the Winner and the Guest on the required date for reasons outside the Promoter’s control, the Promoter will provide accommodation of an equivalent or higher standard in Cairns for that night.

13. Draw

13.1 The draw will take place at 12.00pm AEST (3.00pm New Zealand Daylight Time) on Friday 6 November 2026 at the offices of the Promoter’s related body corporate, Hot Spring Spas New Zealand Limited, 35 William Pickering Drive, Rosedale, Auckland 0632, New Zealand (“Draw”). The random selection will be operated by the Promoter’s representative, with two employees of Hot Spring Spas New Zealand Limited who are not involved in marketing the Competition present as witnesses.

13.2 Before the Draw, all entries will be validated under clause 6 and each valid entry will be assigned a sequential entry number in the order received.

13.3 The Winner will be the valid entry whose entry number is selected first by the random number generator at random.org (or, if that service is unavailable at the time of the Draw, an equivalent computerised random number generator, which will be identified in the Draw record). At the same Draw, the random number generator will then select, in order, three further valid entries as reserve entrants (“Reserve Entrants”). The selection of the Reserve Entrants forms part of the Draw. A Reserve Entrant is offered the Prize only in the circumstances and in the order set out in clause 15, and these Terms set out the manner in which an unclaimed Prize is dealt with.

13.4 The Draw will be video recorded and witnessed by the two employees referred to in clause 13.1, who will sign the Draw record. The recording, the list of valid entries, the entry number assigned to each entry and the random number generator output will be retained by the Promoter in accordance with clause 25.

13.5 If, for reasons outside the Promoter’s control, the Draw cannot take place at the stated time or place, the Promoter will conduct it as soon as practicable afterwards, will publish the new time and place on the Website in advance and will obtain any regulatory approval required.

14. Winner notification and publication

14.1 The Promoter will attempt to contact the Winner by telephone and email on the day of the Draw using the details provided at entry, and will send written notification by email within two business days of the Draw.

14.2 The Promoter will make reasonable attempts to contact the Winner and any Reserve Entrant, being at least three telephone attempts and two emails at different times of day over the acceptance period, and will keep a record of each attempt. Entrants are responsible for ensuring their contact details are correct and for monitoring their email and telephone after the Draw.

14.3 The name and state or territory of the confirmed Winner (being the drawn entrant or Reserve Entrant who has accepted the Prize and whose eligibility has been verified under clause 15) will be published on the Website and on the Promoter’s Australian Facebook, Instagram and TikTok accounts within two business days of that acceptance and verification, and in any event by Friday 20 November 2026, and will remain published for at least 28 days. The Promoter will not publish the name of a drawn entrant who has not accepted the Prize.

15. Acceptance, verification and Reserve Entrants

15.1 Because the Prize is for a fixed-date event, the Winner must do all of the following by 5.00pm AEST on Thursday 12 November 2026 (“Acceptance Deadline”):

  • confirm acceptance of the Prize in writing by returning the Winner Acceptance Form;
  • provide proof of identity, age and residential address under clause 4.2;
  • nominate the Guest and return the Guest Acceptance Form signed in accordance with clause 8.1 and, for a Child Guest, the evidence described in clause 4.2;
  • confirm that the Winner and the Guest are available to travel on the dates in clause 11.4; and
  • return the Participant Safety Acknowledgement signed by the Winner and by an Adult Guest or, for a Child Guest, by the Winner on the child’s behalf (clause 17).

15.2 Acceptance under clause 15.1 is a condition of receiving the Prize. If the drawn entrant cannot be contacted despite the attempts in clause 14.2, does not complete clause 15.1 by the Acceptance Deadline, declines the Prize, is found to be ineligible, or confirms that they cannot travel on the required dates, the Prize is unclaimed by that entrant and will be offered to the Reserve Entrants in the order drawn, as follows:

  • the first Reserve Entrant will be contacted by telephone and email immediately after the Acceptance Deadline and must complete the steps in clause 15.1 by 5.00pm AEST on Monday 16 November 2026;
  • if the first Reserve Entrant does not do so, the second Reserve Entrant will be contacted immediately and must complete the steps in clause 15.1 by 5.00pm AEST on Tuesday 17 November 2026; and
  • if the second Reserve Entrant does not do so, the third Reserve Entrant will be contacted immediately and must complete the steps in clause 15.1 by 12.00pm AEST on Wednesday 18 November 2026 (“Final Cut-off”).

15.3 The Promoter considers that the acceptance periods in this clause give a reasonable opportunity to claim the Prize having regard to its nature as a fixed-date travel and event prize.

15.4 If no drawn entrant or Reserve Entrant has accepted the Prize by the Final Cut-off, the Promoter will deal with the Prize in accordance with the requirements of the relevant state and territory regulators, which may include conducting a further draw where time permits, and will publish on the Website the fact that the Prize was not claimed.

15.5 Once the Winner has accepted the Prize under clause 15.1, the Promoter will make the travel bookings. A Winner who subsequently fails to travel or to attend the Event is not entitled to any replacement prize, cash or compensation, except as required by law.

16. No substitution at the Winner’s request

16.1 The Prize is the advertised Prize. The Promoter does not offer alternative prizes, alternative travel or dates, cash or any other substitute at the request of the Winner or the Guest. The only circumstances in which any element of the Prize may be replaced are those in clauses 12.3 and 24.2, where an element becomes unavailable for reasons outside the Promoter’s reasonable control and the law requires a replacement.

17. Spa Experience and participant safety

17.1 The Spa Experience takes place during the first innings of the Event. The “Experience Period” begins no later than five minutes before the first ball of the first innings and ends no earlier than five minutes after the final ball of the first innings.

17.2 The spa is located on the sideline of the playing field, in the open air, in full view of spectators and broadcast cameras. The spa water will be maintained at approximately 34 to 36 degrees Celsius, or at approximately 34 degrees Celsius where clause 17.10 applies.

17.3 The Winner and an Adult Guest are expected to be in the spa for the Experience Period. They may enter and leave the spa as they wish during the Experience Period and must leave the spa when directed by the Promoter’s staff. A Child Guest takes part in the Spa Experience in accordance with clause 17.10 and may leave the water for breaks and re-enter during the Experience Period. Hot Spring hosts may also be present in or around the spa.

17.4 The Winner and the Guest must bring their own swimwear. The Promoter will provide towels and access to a changing area at the Venue.

17.5 Before entering the spa, the Winner and the Guest must attend a short safety briefing, and the Participant Safety Acknowledgement must have been signed by the Winner and by an Adult Guest or, for a Child Guest, by the Winner on the child’s behalf. The Promoter will not ask for medical information. Each adult participant is responsible for deciding, having read the health advisory in the Participant Safety Acknowledgement, whether spa use is safe for them, and the Winner is responsible for that decision on behalf of a Child Guest.

17.6 The Winner and the Guest must follow all safety, hygiene and conduct directions given by the Promoter’s staff, Event staff and Venue staff, including directions about entering and leaving the spa, glass (no glass is permitted in or near the spa), food, hydration, sun protection and behaviour. Diving, jumping and horseplay are not permitted.

17.7 The Promoter may require a participant to leave the spa, or refuse entry to the spa, if the Promoter’s staff reasonably consider that the participant’s safety or the safety of others may be at risk, including where a participant appears affected by alcohol, heat or illness.

17.8 If the Winner or the Guest is unable or unwilling to use the spa, they may still attend the Hospitality Area and the Event. No alternative or compensation is provided for the Spa Experience. Where the Winner or the Guest has accessibility requirements, the Promoter will discuss reasonable adjustments with them in advance.

17.9 If the Spa Experience cannot proceed or is cut short because of weather, lightning, a safety concern, a direction of the Event Organiser, the Venue or the broadcaster, or any other reason outside the Promoter’s reasonable control, the remaining elements of the Prize still apply and no compensation is payable for the Spa Experience.

17.10 Where a Child Guest takes part in the Spa Experience, the spa water will be held at approximately 34°C, the Child Guest may stay in the water for no more than 15 minutes at a time with a break out of the water between sessions, and the Child Guest must be able to sit on a spa seat with their shoulders above the water unaided. The Promoter’s staff may end the Child Guest’s participation at any time if they consider it unsafe.

18. Alcohol

18.1 The Venue is licensed. Alcohol is served in the Hospitality Area only in accordance with the Venue’s liquor licence and responsible service of alcohol requirements. Venue staff and other authorised personnel may refuse or discontinue service to any person in accordance with those requirements.

18.2 The Winner and an Adult Guest may each be served a maximum of three alcoholic drinks during the Event. This is a maximum, not an entitlement. No alcohol will be served to a person who is or appears to be intoxicated, or to any person under 18 years of age.

18.3 Alcohol may be consumed in the spa only where the Venue permits it, only in non-glass containers, and subject to clause 17 and the directions of the Promoter’s staff. No glass is permitted in or around the spa.

18.4 Where the Guest is a Child Guest, clause 8.5(d) also applies: no alcohol will be served to the Child Guest, and no alcohol will be served to the Winner while the Child Guest is in or beside the spa.

18.5 Alcohol must not be brought into the Venue and may not be taken out of the Hospitality Area in breach of Venue rules.

19. Conduct at the Event

19.1 The Winner and the Guest must behave responsibly and respectfully at all times, must comply with the Event Organiser’s and the Venue’s conditions of entry and must follow the reasonable directions of Event staff, Venue staff and the Promoter’s staff.

19.2 The Promoter may withdraw the Hospitality Area access and the Spa Experience, and Event staff may remove a person from the Venue, where a person behaves in a way that is unsafe, unlawful, offensive or in breach of these Terms or the Venue’s conditions. No compensation is payable in that case.

20. Filming, photography and publicity

20.1 The Event is broadcast live on national free-to-air television and the Spa Experience takes place in view of broadcast cameras and spectators. By accepting the Prize, the Winner and the Guest consent to being filmed, photographed and recorded during the Event and to the Event Organiser and its broadcaster using that material as part of the Event broadcast and the promotion of the Event, in accordance with the Event Organiser’s conditions of entry.

20.2 The Winner and an Adult Guest also agree that the Promoter may use their names, state or territory, images, voices and likenesses, and any footage or photographs of them taken in connection with the Competition and the Event, in any media for the purposes of announcing the Winner and promoting the Competition, the Event and the Promoter’s products and services, for a period of 24 months from the Event, without payment. The Promoter will act reasonably in its use of that material.

20.3 Publication of the Winner’s name and state or territory under clause 14.3 is required by law in some jurisdictions and is not subject to the Winner’s consent.

20.4 Where the Guest is a Child Guest, the consents in clauses 20.1 and 20.2 are given by the Winner as the child’s parent or legal guardian. The Promoter will use footage and photographs of a Child Guest only to broadcast the Event, to announce the Winner and to promote the Competition and the Event, and will not use them in standalone advertising without the separate written consent of the Winner.

21. Disqualification and fraud

21.1 The Promoter may, acting reasonably, disqualify any Entrant, Winner or Guest who:

  • does not meet the eligibility or Guest requirements or is an excluded person;
  • submits more than one entry, or an entry by automated means or other than through the Website;
  • provides false or misleading information;
  • tampers or attempts to tamper with the entry process or the conduct of the Competition; or
  • breaches these Terms or behaves in a way that is unsafe, unlawful or likely to bring the Promoter, the Event Organiser or the Event into disrepute.

21.2 The Promoter’s decisions on disqualification will be made in good faith and communicated in writing with reasons. Nothing in this clause limits an Entrant’s right to make a complaint under clause 2.2 or to a regulator.

22. Privacy

22.1 The Promoter collects personal information from Entrants (name, email address, mobile number, state or territory and postcode) and from the Winner and the Guest (identity documents, date of birth, residential address, travel details and signed forms, and for a Child Guest the child’s name, date of birth and evidence of the Winner’s relationship to the child, provided by the Winner as parent or guardian) for the purposes of conducting the Competition, verifying eligibility, awarding and fulfilling the Prize, publishing the confirmed Winner’s name and state or territory as required by law, and meeting the Promoter’s legal and regulatory obligations. If the information requested is not provided, an entry cannot be accepted or the Prize cannot be awarded.

22.2 The Promoter may disclose personal information to its related bodies corporate (including Hot Spring Spas New Zealand Limited, which assists in administering the Competition), to its service providers (including HubSpot, which hosts the entry form, and the Promoter’s social media and website agencies), to the Event Organiser, the airline, the hotel and transfer providers for the purpose of fulfilling the Prize, and to state and territory regulators where required. Some of these recipients are located outside Australia, including in New Zealand and the United States.

22.3 Competition records, including entries, will be retained for five years after the Competition ends to meet regulatory requirements and will then be securely destroyed, except where the Promoter is required to retain them longer by law. Identity documents and a Child Guest’s details will be retained only for as long as needed to verify eligibility and fulfil the Prize, and then securely destroyed.

22.4 The Promoter’s privacy policy at https://hotspring.com.au/cookie-policy/ explains how the Promoter handles personal information, how to access or correct it and how to make a privacy complaint.

23. Marketing communications

23.1 Entrants who tick the separate marketing opt-in box on the entry form agree to receive news, offers and information about Hot Spring products, events and promotions by email and SMS from the Promoter. Consent is optional, is not required to enter and can be withdrawn at any time using the unsubscribe link in any message or by contacting the Promoter.

24. Changes to the Competition and events outside the Promoter’s control

24.1 If the Competition cannot be conducted as planned for any reason outside the Promoter’s reasonable control (including technical failure, unauthorised intervention, fraud, or the cancellation or postponement of the Event), the Promoter may, subject to any written direction or approval of a relevant state or territory regulator, modify, suspend or cancel the Competition, acting fairly and giving notice on the Website. In Western Australia, these Terms will not be amended and the Competition will not be cancelled after it has commenced without the prior written approval of the Gaming and Wagering Commission of Western Australia.

24.2 If the Event is postponed to a later date, the Prize will be provided for the new date where the Winner and the Guest are able to attend. If the Event is cancelled, or is postponed to a date on which the Winner and the Guest cannot attend, or a material element of the Prize becomes unavailable for reasons outside the Promoter’s reasonable control, the Promoter will provide the remaining elements of the Prize and will deal with the unavailable element as required by the applicable state and territory laws, which may require the Promoter to provide a replacement that is similar and of equal or greater value, to seek the Winner’s written agreement, or to obtain the approval of a regulator. The Promoter does not otherwise provide cash, alternative travel or compensation.

24.3 If the Event commences and is then abandoned, shortened or otherwise altered, the Prize will be treated as having been provided and no compensation is payable, except as required by law.

25. Records and regulators

25.1 The Promoter will keep records of the Competition, including all entries, the validation and numbering of entries, the Draw recording and random number generator output, the record of attempts to contact and the acceptance of the Winner and any Reserve Entrant, and the delivery of the Prize, for at least five years.

25.2 The Promoter will comply with any lawful direction given by a state or territory regulator in relation to the Competition.

25.3 Nothing in these Terms requires a Winner to pay any fee or charge to claim the Prize. Any costs incidental to accepting the Prize (such as travel to the Departure City airport and hotel incidentals) are set out in these Terms and in the published prize description.

26. Liability

26.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.

26.2 Subject to clause 26.1 and to the extent permitted by law, the Promoter is not liable for any loss, damage or injury arising from:

  • any act or omission of the Event Organiser, the Venue, the broadcaster, an airline, the hotel, a transfer provider or any other third party supplier;
  • any delay, change, postponement, abandonment or cancellation of the Event or of travel arrangements outside the Promoter’s reasonable control;
  • any failure of a website, platform or telecommunications system affecting entry; or
  • the Winner’s or the Guest’s own acts or omissions, including failure to follow safety directions, the supervision obligations in clause 8.5 or the Venue’s conditions of entry.

26.3 The Promoter does not exclude or limit its liability for death or personal injury caused by its own negligence.

26.4 The Winner and the Guest are responsible for their own personal property at the Event and at the hotel.

27. Social media platforms

27.1 The Competition is in no way sponsored, endorsed, administered by or associated with Meta Platforms, Inc. (Facebook and Instagram) or TikTok. Entrants release those platforms from any liability in connection with the Competition. Any questions, comments or complaints about the Competition must be directed to the Promoter, not to those platforms.

28. General

28.1 These Terms are governed by the laws of New South Wales, Australia. Entrants residing in other states and territories retain the benefit of the laws of their own state or territory to the extent those laws apply.

28.2 Any dispute about the Competition should first be raised with the Promoter under clause 2.2. Nothing in these Terms prevents an Entrant from contacting a regulator or from exercising any legal right.

28.3 If any part of these Terms is invalid or unenforceable, the remainder continues in effect.

28.4 These Terms are available free of charge on the Website and on request from the Promoter.
