*COMPETITION TERMS & CONDITIONS

1. Entry is open to New Zealand and Australia residents, 18 years of age or older. Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible.

2. The competition prize is for one 4-person Islander Tiritiri spa valued at $10,990 including GST. The spa will come prewired with a standard 10amp plug with ELCB protection that can be plugged into a dedicated household power point. It is the responsibility of the prize winner to ensure that a standard 10amp dedicated circuit electrical power outlet is available within a maximum distance of 9 metres of the proposed spa placement. All power points are to be protected from the weather, rain, mist and fog. HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD accepts no liability for costs associated with additional wiring required for install.

3. Installation and delivery is free within 100km travel distance within Hot Spring Spas authorised dealer serviceable areas in Australia and New Zealand. An extra cost of $1 per km will incur outside this area. Delivery is to the safest and most convenient location onsite. Installation does not include extra labour, cranes or any other lifting devices. It is the responsibility of the prize winner to arrange this if deemed necessary.

4. It is the responsibility of the prize winner to ensure necessary ground preparation is made for their spa pool. A structurally sound, level surface that can support the filled weight of the spa plus the number of spa bathers is required.

5. Installation of a pool or spa must comply with your local council and is the responsibility of the prize winner to check with relevant local body authorities for further information. HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD or any of its associated dealers can not be held responsible or liable for any costs associated with individual circumstances relating to the electrical systems of the customer’s home.

6. HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD shall not be liable for any costs, expenses, loss, damage, personal injury or death whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained arising out of or in connection with the competition, the taking or using of a prize, or any act or omission (whether negligent or not) of the Promoters or any of their associated agencies, except for any liability which cannot be excluded by law.

7. To be eligible to enter the competition all participants must enter via competition form embedded on hotspring.co.nz/spa-giveaway and hotspring.com.au/spa-giveaway websites. To enter the competition, participants must submit a valid first name, last name, email address, telephone, region and submit a photo of spa using the AR Virtual View™ app. Duplicate entries from the same email address will be voided.

8. HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD do not sell, rent or otherwise disclose personal information collected by our website to third parties. If you do not wish to receive promotional or marketing information related to Hot Spring Spas, please unsubscribe from promotional emails.

9. Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully, unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept the decisions of HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD as final and binding as it relates to the content of this Contest.

10. The competition will close at 11:59pm (NZST) on Sunday, 28 November 2021 and one winner will be drawn at random via a unique number generator.

11. The winner will be notified by email or telephone. If three reasonable attempts to contact a winner have been made and that winner is still unavailable, the prize will be forfeited and a new winner will be drawn. The competition prize winner will be published on the HOT SPRING SPAS Australia and New Zealand National Facebook pages and elsewhere at the discretion of HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD.

12. The promoter is HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD. The promoter’s decision is final and no correspondence will be entered in to. The prize is not transferable or redeemable for cash under any circumstances. If for any reason the prize becomes unavailable, the promoter may substitute an alternative equivalent prize without notice. The promoters may change, extend, amend or cancel the competition and its terms at any time at their sole discretion.

13. The information that you provide to enter this competition will be held by HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD and will be used for the purposes of administering the competition. You have the right to access and request correction of this information.

14. The competition promoters shall not be liable for any costs, expenses, loss, damage, personal injury or death whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained arising out of or in connection with the competition, the taking or using of a prize, or any act or omission (whether negligent or not) of the Promoters or any of their associated agencies, except for any liability which cannot be excluded by law.

15. By claiming a prize, the winner consents to HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD making use of their name(s) and/or photograph(s) for publicity purposes as determined by Promoters (such as via its social media channels and website).

16. The promoters assume no responsibility for any failure to receive an entry as a direct or indirect result of a technical problem or any kind of internet malfunction. Entries are deemed to have been received at the time of receipt of transmission into the website database, not the time of transmission by the entrant.

17. All entries become the property of HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD.

18. Incomprehensible or incomplete entries and any entry that does not comply with these terms and conditions shall be deemed invalid.

19. Where goods or services are supplied by third parties, the promoters do not warrant the quality of those goods and/or services or the suitability for your circumstances.

20. The promoter’s decisions on all matters regarding the competition are final and no correspondence will be entered into.

21. The 4-person Islander Tiritiri spa is to be delivered within 28 days of the prize being drawn. However, in the event of shipping delays it can exceed this period. Winner will be contacted and advised of a new delivery date.

22. HOT SPRING SPA AUSTRALASIA PTY LTD & HOT SPRING SPAS NEW ZEALAND LTD will not be liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is: i) beyond the reasonable control of a party ii) materially affects the performance of any of its obligations under this agreement, and iii) could not reasonably have been foreseen or provided against, iv) will not be excused for failure or delay resulting from act of God (such as, but not limited to, fires, explosions, earthquakes, drought, tidal waves and floods); only general economic conditions or other general market effects.
