Do you need a building permit for a spa pool in Victoria?
According to Victorian law, you must have a building permit for spas deeper than 300mm, including above-ground spas.
There is an exemption for what the legislation terms ‘portable’ spa pools – a designation that applies to our models – but the fact remains that any spa deeper than 300mm, portable or in-ground, is required to have a spa safety barrier installed around it, which does require a building permit.
It is therefore critical that you seek building permission from your local government before proceeding with your spa pool purchase.
Do you need a fence around your spa pool in Victoria?
As outlined above, any spa pool deeper than 300mm – the entire Hot Spring range – must be surrounded by a safety barrier in Victoria. Installing such a barrier requires a building permit, so be sure to speak with your local council.
A list of pool safety barrier requirements can be found at the Victorian Building Authority website. Generally we say that if the spa pool is free standing and above ground, then you commonly only need to fence the step area. Any sinking into ground or decking built up to the pool will also require fencing.
How to register your spa pool with your local Victoria council
On the 1st of December 2019 it became mandatory for Victorian spa pool owners to register their spa with the relevant council. The process for registering your Hot Spring spa pool can differ from council to council, so get in touch with your local office or visit the Victorian Building Authority website for more information.
Alternatively, Hot Spring Melbourne has a working relationship with an independent certifier (Australian Pool Permits) who can help you to register your spa and obtain the necessary permits. We have found that using a certifier - as opposed to dealing directly with councils - greatly speeds up the process.
